Welcome to Mindjot! This page describes the Mindjot Privacy Policy. Your use of the mindjot.com system signifies your acceptance of and agreement with the policy as described in this document. If you do not agree with this policy, then you may not use the Mindjot system. If we make any significant changes to this policy, we will notify you by posting a notice of such changes on the sign in page.

1. Information We Collect and How We Use It

We collect different levels of information, depending upon your relationship to Mindjot.

1.a. Anonymous Website Visitor: If you visit our websites we automatically record information related to your IP address, Mindjot cookie information, and aggregate information on what content you access or visit. This information is collected in the background while you move around our website.

1.b. Mindjot Member: As a member, you must have a unique UserID and password, and complete the registration form. Your initial UserID will be your valid email address, and we will send you an email with a link, so that you can verify the email address. You may change your UserID after completing registration. During registration and usage of the site we collect and aggregate a variety of data to verify your unique identity, monitor system performance, deliver content, and aid email delivery such as email address and message performance statistics. This includes specific and general information about your computer hardware and Internet connection. We track usage of customer-service resources in order to ensure high quality interactions. This is in addition to any company data, personal demographic data, preferences, and billing information collected during the registration process.

You are also required to provide personal and company demographic data during registration, including a validated Email Address, Full Name, Company Name, Job Title, Company Address (Street / City / State or Province / Country / Postal Code) and Office Phone Number. In addition, if you choose to use the SMS services of the System, you will be required to provide and validate your SMS Number. In addition to the Required Information, Mindjot also allows you to store Optional Information within your Account, such as your Mobile Phone Number, Alternate Phone, Fax Number, etc.

This information is never shared by Mindjot in a personally identifiable way - it is only used by Mindjot to provide aggregate usage statistics to members. If you choose to contact other Users within the System, however, you will yourself be passing the Required Information to them directly.

From time-to-time you will receive service-related email messages from mindjot.com - these cannot be turned off. If you do not wish to receive them, you may close your Mindjot account. Mindjot is the sole owner of the information collected on mindjot.com.

1.c. Response to Job Postings or Unsolicited Communications: Please note that information we receive in reference to a job posting or via unsolicited communications does not fall under the privacy terms outlined in this policy. However, information from your resume will be used solely for the purposes of evaluating your candidacy for employment.

Individuals Outside of the United States: Anyone using the Mindjot system from outside of the United States should be aware that personal Information collected on these websites may be stored and processed in the United States or any other country in which Mindjot or its affiliates, subsidiaries or agents maintain facilities, and by using these websites, you consent to any such transfer of information outside of your country.

1.d. Former Customer: If you cease being a customer of ours, we will delete all of your Personally Identifiable Information (PII) within 30 days of the cancellation of your account.

1.1. Personally Identifiable Information (“PII”)

1.1.a. Email Address

This must be unique across all users, and which you will use to sign in to the system until such time as you choose a UserID. Your Email Address is required in order to prove that you are a human, and not an automated sign-up system. Therefore, you must receive and respond to an email sent to your Email Address. It also serves as a clear indicator of who you are whenever you send a contact request to another member. After you complete your registration, you may change your old Email Address by re-validating it with a new Email Address. This data is transmitted by you if you contact other Mindjot users.

1.1.b. Full Name

A second confirmation, in a more human-readable format than email addresses, of who you are, and that you are who you say you are. This data is transmitted by you if you contact other Mindjot users.

1.1.c. Company Information

This includes Company Name, Job Title, Office Phone Number, and Company Address (Street / City / State or Province / Country / Postal Code). This data is transmitted by you if you contact other Mindjot users.

1.1.d. SMS Number

If you choose to use the SMS services of the System, you will be required to provide and validate your SMS Number by responding to a text message with a separately provided code word. Knowledge of the code word and physical control of the SMS device constitute the ability to validate an SMS Number. This data is not transmitted by you if you contact other Mindjot users.

1.1.e. Optional Information

In addition to the Required Information, Mindjot also allows you to store Optional Information within your Account, such as your Mobile Phone Number, Alternate Phone, Fax Number, etc. This data is not transmitted by you if you contact other Mindjot users.

1.2. We calculate aggregate usage statistics across several demographic categories and may report this data, without revealing PII, to:

1.2.a. Trade show and convention exhibitors wishing to gauge the effectiveness of their event budget and event experience,

1.2.b. Trade show and convention producers wishing to gauge the effectiveness of their event in bringing together attendees and exhibitors, and

1.2.c. Trade show and convention attendees so that each attendee can benefit from the collective knowledge and experience of the other attendees

1.3 Also, we use this data for billing and administrative purposes

2. Disclosing Your Own Personal Information

You will yourself disclose personal information during interactions with other members or with non-members, in such areas as publishing your mCode page, making a contact request, or sending a sharing request, etc. Please be aware that such information, once disclosed by you to another, is public information and Mindjot’s Privacy Policy does not apply in these situations.

As part of a published mCode page, you will disclose your Full Name and Company Information. If you do not wish to disclose this information, please do not publish an mCode page within the Mindjot system.

As part of each contact request to another member, you will disclose your Email Address, Full Name, and Company Information. If you do not wish to disclose this information, please do not initiate contact requests within the Mindjot system. You may also choose to disclose other information in the body of the contact request, at your own discretion (such as your mobile phone number, etc).

At no time will any other member be able to see your personal information unless you authorize them to view it (such as publishing your mCode page, etc), or send it to them (such as a contact request or sharing request, etc).

Mindjot takes no control of any personal information that you disclose to another member. Once you disclose data to another member, the data will be controlled by the member you disclose it to.

3. Browser Safeguards

During the course of your registration, your Email Address may appear in the URL or address bar in your web browser. Please be aware that whenever you leave one web site and go to the next web site, the web site you visit next may be able to read the URL of the web site you visited previously.

You can prevent your Email Address from becoming visible to another web site by either completing the registration process before you go to another web site or by deleting the Email Address information in the address bar of your web browser and reloading the mindjot.com main page anonymously before you go to another web site.

4. How Our Security Practices Protect Your Personal Data

We follow generally accepted industry standards to protect your personal and business data when transferring, receiving and storing this data. No method of transmission over the Internet, or method of electronic storage is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. If you have any questions about security on mindjot.com, please send us an email at the address listed at the end of this page. Access to your data is limited to Mindjot employees or third parties who require the information in order to provide products or services to you or perform their jobs. These third parties include software developers and website hosting facilities.

All third party service providers are and will be bound by agreements prohibiting the use or disclosure of your personal data except as provided in this policy.

Mindjot does not share, sell, rent, or trade PII with any third parties for promotional purposes.

All passwords are stored on our server in encrypted form - not even we can tell what they are. If you lose your password, you can generate a new link to your registered Email Address so you can sign in and change it yourself.

5. How to Access Your Personal Data

To update or correct your PII, simply click the Manage My Account tab once you have signed in to the system, and edit the information there. You may do this as often and whenever you please.

To delete your PII, you must close your Mindjot account. To do so, please send us an email to the address listed at the end of this mail, and we will delete your account, and all of your PII, within 30 days.

6. Emails and Recommendations that You Will Receive

Mindjot does not spam its members. Period. If you think something we have sent you qualifies as spam, by all means let us know, because that certainly is not our intention. Additionally, if you feel that a communication from another user qualifies as spam, please bring it to our attention immediately.

Before and after events, Mindjot sends out notices of relevant information to members associated with that event. You can turn these emails off if you wish, by clicking Manage My Account and then selecting the checkboxes to “Opt-out” for that event.

Mindjot sends email reminders to your registered Email Address whenever you save another member’s mCode page. At present, these emails cannot be turned off.

Mindjot sends email reminders to your registered Email Address whenever another member has initiated a contact request, so that you may view this contact request. At present, these emails cannot be turned off.

Some events include Mindjot as a free service to their attendees. For new members who have been automatically created based on an event registration, we may send you an email with a “one-use” link to sign in to the system, change your password, and complete the registration process. These emails may be registered as coming from mindjot.com, or from the registration company or their customer, and cannot be turned off.

For existing members who have forgotten their password and clicked on the password recovery link, we will send you an email that contains a “one-use” link to sign in to the system and change your password. Obviously, these emails cannot be turned off.

Also, in order to inform you of Service Changes or Interruptions, or of Business or Policy Changes, we reserve the right to send you an email from time-to-time. These emails will be infrequent and cannot be turned off.

7. Cookies and Log Files

You must accept “cookies” for the site to work properly. We use cookies to enhance your interaction with the site. The information we store in the cookies relates to your session, so that we know where you are in the site and how best to deliver you the next page you request. Longer-term cookies are stored as a convenience to you in order to keep you signed in to the system until you physically click the button to sign out, which deletes the cookie. The only PII stored in the cookie is your UserID, which enables you to automatically sign in to the system the next time you come to the site. To delete this cookie, please click the Sign Out button/link each time you are finished using the website.

There are no third-party cookies on the Mindjot website.

As is done with most web sites, we log each visit to each web page. A log entry can contain information typically found in the “header” of your web browser’s request such as the browser type you used, your Internet Protocol address, and the date and time of day. We may also log your cookie’s identification number and the URL of the last site you visited. This log information is important for security, audit, quality improvement, as well as for monitoring the health of our service.

8. Your Consent

Periodically we may need to update our privacy policy to reflect changes in the types of information we collect, the means we use to collect information, and/or our usage of collected information. When this occurs we will notify you by posting a notice of such changes on the sign in page.

Your use of the Mindjot system and/or any Mindjot products or services noted above signifies your assent to this Mindjot Privacy Policy.

9. Disclaimer

Mindjot reserves the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Web site.

10. Exceptions to this Privacy Policy for “Stalkers”

Any user who “stalks”, abuses or attempts to abuse, or otherwise harasses any other user loses any claim of privacy under this policy. This includes any attendee attempting to contact any exhibitor to sell to them. The Mindjot system is for use by attendees to purchase from exhibitors, not sell to them.

Any violation by you may result in immediate and permanent suspension or cancellation of your Account.

You agree that Mindjot may take whatever steps it deems necessary to abridge, or prevent behavior of any sort on the System in its sole discretion, without notice to you, including releasing your Personally Identifiable Information to the proper authorities. (In plain English, we won’t release your information without a subpoena, but in the case of stalkers we reserve the right to go to the authorities and ask for that subpoena.)

11. Changes to Mindjot Policies

If Mindjot makes Material Changes to any of our policies, these will be posted on the main sign in page, and / or sent to you by email. If you disagree with these changes you are free to cancel your membership at any time.

12. TRUSTe

Mindjot is a licensee of the TRUSTe Privacy Program.TRUSTe is an independent, non-profit organization whose mission is to build user’s trust and confidence in the Internet by promoting the use of fair information practices.This privacy statement covers the Web site www.mindjot.com. Because this Web site wants to demonstrate its commitment to your privacy, it has agreed to disclose its information practices and have its privacy practices reviewed for compliance by TRUSTe.

Mindjot complies with the EU Safe Harbor framework as set forth by the Department of Commerce regarding the collection, use, and retention of data from the European Union.
